We are currently working on an underinsured motorist claim where our client obtain extensive medical treatment, and some of it was paid by her health plan. When a health plan is involved in an Oregon or Washington auto injury case, it can change the dynamics of a case.
Generally, health plans that pay medical bills for people who have a claim from an auto collision injury want their money back. Often, they hire out the collection of those reimbursements to third party companies, who are glorified collection agents. Sometimes these companies will try to collect more than they are entitled to, either because they are lazy about sorting out which medical care is related to an accident, or they just cannot figure it out from the information they have. This can be an innocent oversight.
When we represent someone in a serious injury case, part of our job is helping the health plan know what is and what is not related in terms of medical bills. We also make sure we know the plan language, and how much the plan is entitled to for reimbursement. In some cases, we are able to negotiate the reimbursement to put our client in the best position possible.
